1.Under Clause 8 of this bill of lading, if the goods are not taken delivery of by the Receiver

This will serve to remind you that M.V. “China Sea” which arrived at this port on 10th June from London, is now discharging cargo at Dock/Wharf No. 9 and will have reached the end of her stipulated laydays at 1500 hrs of this month.

No.324 dated 18th March that on behalf of China Minmetals Imp & Exp Corp, we settled the accounts with you under Sate Contract 2FEE09019D. All the accounts were settled under the terms of the said Sale Contract except daily rate of Dispatch money/Demurrage calculated under the C/P, of which you will have a better understanding.

Enclosed please find two copies of our Statement of Account for check. If you have any objection异议, please don’t hesitate to let us know by reply.

6.The stevedores handled the goods in such a way that the mix-up of parcels is inevitable.

L15 CLAIMS AND SETTLEMENTS

1.The shortage of this consignment arrived is obviously caused by your careless mistake in

packing, which should have been avoided if you had given your due attention to the packing.

Therefore, we reserve our right to lodge a claim for the said consignment.

2.Upon perusal of the relevant documents, we are of the opinion that the said claim

should be rejected on the following grounds/for the following reasons.

3.With reference to the claim you filed against us for the water damage to cargo in shipment

under B/L HF175, we wish to offer 25% discount of the amount claimed to compensate for the loss you sustained. Please note that this is our maximum/farthest concessio n we can afford. Should you insist on your original claim, we would propose to submit the case to arbitration for final settlement.

4.As 8 cases of bicycle parts overlanded were pilfered in large quantities in your warehouse

and are not enough to offset those shortlanded in Rotterdam, we have to settle the case by paying US$ 1200 to the consignee as compensation. Please debit the said amount into our account.

5.Obviously the said loss occurred during the transit when the cargo were under your custody.

Therefore, we hold you liable for the loss amounting to 2500 USD.
